SUMMARY OF COMMONLY VIOLATED RULES OF THE SOUTHERN TRACE PROPERTY OWNER’S ASSOCIATION
The following is a summary of the commonly violated rules of the Property Owner’s Association with which you should become familiar. Please refer to the recorded Protective Covenants of Southern Trace if you have any questions concerning the following regulations.
Storage of Vehicles or Equipment – 3.14
Boats or recreational vehicles may not be stored in public view in the Southern Trace Community. Parking on Streets of Southern Trace -Residents shall not use the private streets parking vehicles. In addition, vehicles may not be parked on private streets for longer than ten (10) hours or on a semi-permanent or daily basis unless permitted under Item 3.14- Storage of Vehicles or Equipment.
Vehicles Permitted to Use Private Roads – 3.26
The use of non-licensed motor vehicles including automobiles, trucks, motorcycles, dirt bikes, off-road vehicles and go-carts is expressly prohibited on the streets comprising the Southern Trace Community. Motor homes may not be parked in public view unless permitted under Item 3.14 – Storage of Vehicles or Equipment.
Walls, Fences, and Hedges – 3.8
All fencing in Southern Trace is subject to Architectural Control approval. Chain link fences are not allowed in the Southern Trace Community. No fence may be built that would unreasonably obstruct the view of the golf course by adjacent property Owners. Construction Silt Fences- The Architectural Control Committee requires silt fences on all construction sites located on the golf course and in all areas where soil may be washed onto adjoining property of the Southern Trace Community or other property Owners.
Lot and Unit Maintenance – 3.16 / Landscaping – 3.29
All landscaping in the Southern Trace Community is subject to the Architectural Committee approval process. Landscaping including lawns, flower beds and hedges must be property maintained in the Southern Trace Community. All lots and homesites shall be kept neat, attractive, healthful and in a sanitary condition. Grass on lawns should be cut and maintained properly (including necessary weed control.)
Animal Husbandry – 3.15
Pets must be subject to the leash laws of Southern Trace Community. No more than two (2) of each type of animal shall be kept as household pets.
Garage and Garage Doors – 3.2.3
All garages must be finished with sheet rock, taped, and painted or other finish approved by the Architectural Committee. Garage doors visible from any street shall be kept in the closed position when the garage is not being used by the Owner or occupant.
Prohibition of Offensive Activities – 3.12
No obnoxious or offensive activity of any sort shall be permitted which may be or may become an annoyance or a nuisance to the Southern Trace Community. No obnoxious activity including activities by reason of odor, noise, vision, shall be permitted in the Southern Trace Community. No horns, whistles, bells, or exterior speakers may be used that would constitute a nuisance or annoyance. The Board shall have sole and absolute discretion of what constitutes a nuisance or noise.
Utility Easements – 5.3
Prior to digging on any lot or unit, the Owner should contact the public utility companies to locate the lines within granted servitudes. If an Owner damages public utilities by digging, the Owner shall be responsible for repairs.
Removal of Trees, Trash & Care of Lots and Units during Construction of Residence – 3.5
During the construction of a residence, it is the Owner’s responsibility to monitor debris and trash at their construction site. The Owner shall instruct their builder and subcontractors to abide by this provision.
Exterior Maintenance of Improvements – 4.1
Any construction contemplated at residence, including painting, remodeling, and additions must be approved in advance by Architectural Control Committee.
Use of Temporary Structures – 3.13
No structure of a temporary character whether trailer, tent, shack, garage, or outbuilding shall be used at any time at a residence unless approved in advance by the Architectural Control Committee.
Antenna & Television Satellite Dishes – 3.18
Radio or television aerial wire antennae or a satellite receiving dish is not allowed on a Lot or Unit, except as permitted by the Architectural Control Committee. The homeowner should submit in writing the location of a small dish to the Architectural Committee for approval.
Maintenance of Drainage – 10.11
Lot Drainage must be considered during the home planning process. No Owner shall interfere with the established drainage pattern of a lot. The Architectural Committee may require a drainage plan or other measures to the improvements which will protect adjoining neighbors from drainage problems.
Speed Limits
Speed limits are controlled by the Property Owner’s Association as the streets are private in the Southern Trace Community. Speed Limit signs are posted throughout the Community and should be strictly adhered to. The Property Owner’s Association reserves the right to enforce these limits by hiring police and writing citations for violations. Please report any speeding to the Security Officer on duty with a description of the vehicle.
Use of Southern Trace Country Club
Property Owners should be aware that the golf course and cart paths should not be used for walking or jogging during the hours the Country Club is in operation. Adult family members are the responsible parties and should make their children aware of this policy. The Property Owner’s Association will notify the parents of children who do not adhere to this policy. Fines may be levied at the discretion of the Association.
Children in the Community
Children are not allowed on other people’s property including construction sites. Bicycle riding and skateboarding on the cart paths and the golf course is strictly prohibited. Skateboarding on the Country Club Property, including the parking lot is prohibited. Children are not allowed to drive motorized vehicles, especially go-carts and golf carts, in the subdivision. Carts are not covered by insurance. Please do not allow children under 16 to drive the carts.
Signage
All on-site signage is controlled by the Developer and the Architectural Control Committee. Only homes “for sale”, lots “for sale” and commercial builders may advertise within the Southern Trace Community, as approved by the Architectural Committee.
Violations of Covenants Periodic Periodic inspections will be made in the Subdivision by members of the Property Owner’s Association. An Owner will be notified in writing if a violation exists at your home or lot. Please rectify the situation immediately or notify the STPOA of the expected date for correction of the violation(s).
Architectural Approval Process
All improvements (homes, fences, landscaping, etc.) must be submitted and approved before construction is begun. All changes to existing homes (painting, fencing, etc.) must be approved in advance. The restrictions of the Southern Trace Community will be your reference for the orderly development of homes and homesites in the Community. These restrictions are available by request to STPOA.
